Champix Class Action Update

In December Pfizer produced tens of thousands of documents, purportedly all the documents it is required to provide in this action.  We are in the process of reviewing those documents in detail.  Our initial review suggests that not all necessary documents have been produced.

In early January a case conference was conducted by the judge overseeing the lawsuit.  The judge set the date of June 5, 2014 to hear any motions needed in respect of the documents Pfizer has produced.

It is expected that examinations for discovery of a Pfizer representative and the representative plaintiff will be conducted.

A date for the common issue trial has not yet been set but it is presently expected to be held sometime in 2015.

Class members are reminded to be obtaining copies of their medical and pharmacy records and any other documents relating to their claim.  If the class member intends to make a claim for loss of income they should also be collecting the documents necessary to prove such a claim.  These documents might include tax filings and T-4 slips.  If a class member has significant past and/or future health care costs associated with his or her ingestion of Champix, it is important to have documents showing or estimating those costs.  Class members are also invited to register with our firm at www.mcst.ca so as to facilitate future direct communication from our firm.  Registration also assists in assessing the scope of alleged injuries suffered and the number of claimants.  Registration does not establish a lawyer-client relationship with the firm; that may only be done by way of a retainer agreement.
