McPhadden Samac Tuovi (“MSMT”) has commenced a class action proceeding against former doctor Jacobo Joffe ("Joffe") and The Scarborough Hospital (“TSH”).

The allegations made in this action against Joffe are quite similar to those made in the proceeding commenced against him by the Ontario College of Physicians and Surgeons.  In that proceeding, it was alleged that Joffe had sexually assaulted patients on which he had performed bariatric surgery.  Joffe entered a plea of no contest in the proceeding by the College.  The College ordered that Joffe’s licence to practice medicine in Ontario be revoked. Claimants (TSH patients who allege they were sexually assaulted by Joffe) are encouraged to contact MSMT by registering online or by contacting one of the firm’s lawyers directly.

After the defendants (Joffe and TSH) are served with the Statement of Claim and Order in this civil proceeding, the next step will be to have the court certify the action as a class proceeding.  It is anticipated that this step will take months and possibly longer.
